Terms of Service

1. Acceptance of Terms

By accessing or using Tucci Cash ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you and Tucci Cash ("Company," "we," "us," or "our").

2. Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms. The Service is not available to users in jurisdictions where cryptocurrency services are prohibited by law.

3. Account Registration

To access certain features of the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the security and confidentiality of your login credentials
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

4. Services Description

Tucci Cash provides the following services:

  • Virtual Cards: Cryptocurrency-funded virtual debit and credit cards for online and in-store purchases
  • Token Swaps: Decentralized exchange aggregation for trading digital assets on the Solana blockchain
  • Wallet Services: Non-custodial cryptocurrency wallet management
  • Vault Storage: Secure storage solutions for digital assets

5. KYC/AML Compliance

Certain features of the Service, including virtual card issuance, require completion of Know Your Customer (KYC) verification procedures. You agree to provide accurate identification documents and information as requested. We reserve the right to refuse service, terminate accounts, or cancel transactions if we suspect fraudulent activity or non-compliance with applicable anti-money laundering (AML) regulations.

6. Fees and Payments

The Service may charge fees for certain transactions, including but not limited to card issuance, transaction processing, and currency conversion. All applicable fees will be disclosed before you confirm any transaction. Fees are non-refundable unless otherwise stated. We reserve the right to modify our fee structure with reasonable notice.

7. Prohibited Activities

You agree not to use the Service for:

  • Any unlawful purpose or in violation of any applicable laws or regulations
  • Money laundering, terrorist financing, or other financial crimes
  • Fraudulent transactions or misrepresentation of identity
  • Circumventing geographic restrictions or sanctions
  • Interfering with or disrupting the Service or its infrastructure
  • Reverse engineering, decompiling, or disassembling any part of the Service

8. Risk Disclosure

Cryptocurrency transactions involve significant risks, including but not limited to price volatility, regulatory uncertainty, and technological vulnerabilities. You acknowledge that you understand these risks and accept full responsibility for your investment decisions. The value of digital assets can fluctuate significantly, and you may lose some or all of your investment.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TUCCI CASH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT OF FEES PAID BY YOU IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify, defend, and hold harmless Tucci Cash and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Service after such modifications constitutes your acceptance of the revised Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Tucci Cash is incorporated, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved through binding arbitration in accordance with applicable arbitration rules.
